Tier 2 reports are digital or paper forms that organizations and businesses in the United States must fill out and submit each year if they possess hazardous chemicals above certain quantities. These reports provide specific information on potential hazards at a given property, such as the location and quantities of hazardous chemicals, and contact information for the designated emergency point-of-contact. This information helps state and local agencies plan for and respond to chemical emergencies.


There are actually two different reports you can submit under EPCRA: Tier 1 or Tier 2 reports. Tier 2 reports include all of the information found the on the Tier 1 report, plus additional information. Most states require the more comprehensive Tier 2 report. While Tier 2 reporting is mandated by the EPA through Section 312 of the Emergency Planning and Community Right-To-Know Act (EPCRA) – also known as SARA Title III – the program is left up to the states to administer. Tier 2 reports must be submitted by March 1st each year to local fire departments, Local Emergency Planning Committees (LEPCs), and State Emergency Response Commissions (SERCs). How you submit these reports, as well as what is required on them, depends on the state you are reporting in. This can make reporting complicated, and mistakes are costly - noncompliance penalties can reach $54,789 per violation, per day.
